Juul Labs Inc on Friday asked a federal appeals court to block the Food and Drug Administration’s (FDA) decision to ban its e-cigarette products from the market.
The company asked the US Circuit Court of Appeals in Washington for an emergency stay order, saying, “FDA’s extraordinary and unlawful action, which demands that JLI immediately halt essentially all of its business operations, warrants the emergency interim relief requested.”
According to FDA Commissioner Robert Califf, a rise in teenage use of vaping products had compelled the agency to conduct a thorough review of e-cigarettes.
Moreover, the health agency also said to keep selling its vaping device and menthol- and tobacco-flavored nicotine pods, Juul gave insufficient or conflicting data about the potential risks of the products.
Juul claims the FDA action was “arbitrary and capricious” and that agency did not consider the evidence before making a decision.
The company also called out the agency for imposing immediate enforcement rather than instating a transition period, which is typical unless the product poses an immediate risk to consumers.
