Elon Musk countersued Twitter Inc (NYSE: TWTR), intensifying the legal fight against the social media platform over his bid to walk away from the $44 billion purchase.
Musk’s legal team filed a confidential countersuit in a Delaware court on Friday, and the 164-page lawsuit is not yet available to the public. However, a version of it could be made public soon with sensitive details redacted.
The lawsuit from the billionaire came days after Delaware Court of Chancery Chancellor Kathaleen McCormick ordered a five-day trial beginning October 17 to determine if Musk can walk away from the deal.
Musk, the CEO of Tesla Inc (NASDAQ: TSLA), earlier last month said he was abandoning the takeover and blamed Twitter for breaching the agreement by misrepresenting the number of fake accounts on its platform.
Twitter sued days later, calling the spam account claims a distraction and saying Musk was bound by the merger contract to close the deal at $54.20 per share.
The social media company has also blamed the court fight for slumping revenue and causing chaos within the company.
